These terms govern your purchase of a hot air balloon flight from Sandia Sunrise Balloons LLC ("we", "us"). By booking, you agree to them.
Who you are contracting with
Sandia Sunrise Balloons LLC is the seller and the operator of the flight. Your contract is with us. We are an independent operator and are not affiliated with, endorsed by, or part of the Albuquerque International Balloon Fiesta, and we do not sell admission to that event.
Booking and confirmation
A booking is confirmed when payment succeeds. You receive a ticket by email with a QR code. A shared-flight ticket admits one passenger. A private-flight booking reserves the balloon for up to four passengers at a flat price, whether or not you bring four.
Waivers are required
Every passenger must complete and sign a liability waiver before flying. A passenger who has not signed will not be permitted to board, and no refund is owed in that case. A parent or legal guardian must sign for a minor.
Passenger weight
A balloon is flown to a weight limit set by its aircraft certification and by the day's conditions. We ask each passenger's weight on the waiver and use it solely to plan the load and fuel. If the weights we are given prove materially inaccurate on the day, the pilot may have to reduce the passenger count for safety, and we will refund anyone who cannot fly for that reason.
The pilot's authority
The pilot in command has final authority over whether, when, and where a flight operates, and may delay, shorten, divert, or cancel a flight at any point for weather, wind, visibility, airspace, equipment, or any other safety reason. The pilot may also decline to carry a passenger who appears impaired, is unable to follow safety instructions, or whose participation the pilot judges unsafe.
Assumption of risk
Ballooning carries inherent risks that cannot be eliminated, including rough or hard landings, weather exposure, and injury. You accept those risks when you fly. The waiver you sign before your flight sets out the full release and governs over any summary here.
Payments
Payments are processed by Stripe. Card details are entered directly with Stripe and never reach our servers. Prices are in US dollars and include the flight only, unless stated otherwise.
Limitation of liability
Except where the law does not allow it to be limited, our liability arising from a booking is limited to the amount you paid for that booking. Nothing here limits liability for death or personal injury caused by negligence where the law forbids that limitation.
Governing law
These terms are governed by the laws of the State of New Mexico, and the courts of Bernalillo County, New Mexico have jurisdiction over any dispute.
